FORT WAYNE, Ind. (Indiana’s NewsCenter) - The Blackhawk Middle School teacher charged with sexual misconduct with a minor has resigned effective February 1, 2011.
Meanwhile, the Fort Wayne School Board accepted 38-year-old Justin Edwards resignation Monday night.
"I'm responsible for insuring parents that when we find out someone has misbehaved around a child they don't go back. So whether they resign, retire... doesn't matter at this point. Not gonna be working in Fort Wayne Community Schools," passionately stated Fort Wayne Community Schools Superintendent Dr. Wendy Robinson.
But if the district wanted to fire him, it would have at least taken 40 days.
State law says Edwards would have the 40 days to file an appeal.
However, when the allegations surfaced in late 2010, FWCS officials shared that Edwards was removed from the classroom and all of his teaching and coaching duties.
Meanwhile, it appears that if Edwards didn't resign Monday night, he was only weeks away from being fired.
The Allen County Prosecutor's Office filed the felony count of sexual misconduct with a minor against the Blackhawk Middle School science teacher and wrestling coach on Friday.
Edwards had turned himself in earlier on Friday.
He's now out on bond.
The teenage girl involved in this case is now in high school.
According to court documents, she told police she and Edwards had sex several times.
The probable cause report from the Prosecutor’s Office highlights at least one sexual encounter inside the wrestling mat room at Blackhawk Middle School.
The report goes on to say that alleged encounter took place during summer break.
We're told the alleged sexual relationship took place between July 2010 and November 2010.
"Any time in my time as superintendent that there is an allegation of an adult misbehaving, they are dealt with swiftly and within the laws of the state," said Dr. Robinson.
According to court documents, Edwards denied having a sexual relationship with his former 8th grade student.
Those same court documents say "she (the teenage girl) would often talk to Mr. Edwards like he was her other dad, and they often communicated via text messages."
Edwards will appear in court for his initial hearing Tuesday morning.
