State Denies Tort Claim for Inmate's Death

INDIANA (www.incnow.tv) -The state of Indiana says it won't settle out of court with the family of Rachel Wood, who claims the Department of Correction is to blame for the prison inmate's death.

The 24-year-old Huntington County woman was locked up for dealing painkillers.

She got sick behind bars from complications of lupus, started coughing up blood, then died in April on her way to a long-term care facility.

A coroner's report listed the manner of death as therapeutic misadventure, suggesting doctor error.

Her family filed a tort claim, a first step towards a lawsuit.

The state has just ruled a settlement is not warranted, and the claim is denied.

The case could now go to trial.
