FORT WAYNE, Ind. (www.incnow.tv) - Criminal charges will not be filed against an Indiana State Trooper who shot and killed a Fort Wayne man during a confrontation last year, the Allen County prosecutor's office announced Friday.
In May, Trooper Seth Mann was driving along West Main Street when he noticed a man on the ground, allegedly being kicked by Lucius Washington.
The trooper turned around, stopped at the scene and chased Washington, who is said to have tried to jump a fence during the pursuit.
That's when Washington, who was unarmed, went for Mann's gun, the trooper says. Mann claims he fired in self defense.
Brenda Washington, Lucius' mother, is dissatisfied with the investigation, citing conflict of interest because state police from the Fort Wayne Indiana, where Mann is assigned, led the investigation.
"I don't want my son's death to be in vain," Brenda Washington says. "I want to know the truth, and I don't feel like this is the truth."
Indiana State Police say it is their policy to lead investigations of one of their own, because they have the expertise and resources to do so. ISP adds that if prosecutor Karen Richards, R-Allen County, wanted another agency to take over the investigation, state police would have complied.
Ultimately, Richards says the evidence shows Mann did nothing criminally in Lucius Washington's death.
"We could get an idea what the scene looked like," Richards says. "After everything, we've determined that there's insufficient information for there to be criminal liability in this case."
A friend of a Washington, who witnessed the police-action shooting, says Washington was the one who did nothing wrong.
"Yeah, he walked away," James Broadnax says. "But that doesn't give you the right to shoot him. He didn't fight with you or nothing. You shot him five to seven times; that's ridiculous."
Mann has been a trooper since 2007, and has no disciplenary record with the Indiana State Police.
