WARSAW, Ind. (21Alive) -- It's back to adult court for a Kosciusko County teen accused of killing a friend's stepfather.

Paul Gingerich was 12 when he assisted his friend, Colt Lundy, in killing 49-year-old Phillip Danner in Danner's Cromwell home back in 2010. He pleaded guilty to conspiracy to commit murder and was sentenced to 25 years.

A state appeals court threw out the plea saying the Kosciusko County judge rushed when he waived the case to adult court. Monday afternoon, Gingerich and his attorney signed a waiver back to adult court with the understanding that there will be a plea agreement.

Gingerich will be back in court December 16th.
