October 28, 2013 Updated Oct 28, 2013 at 4:04 PM EST

KNOX COUNTY, Ind. (RTV6) -- An Indiana man was killed early Monday morning when he was struck by Jason Aldean's tour bus, police said.

The bus was northbound on U.S. 41 north of Vincennes when the pedestrian was hit.

Knox County Sheriff Michael Morris said the victim was identified as Albert Kennedy, 49, whose last known address is in Bruceville, Ind.

Morris said Kennedy is a transient who has been known to walk U.S. 41 at night.

Kennedy was pronounced dead at the scene of head and chest trauma.

The investigation continues, but Morris said charges will not be filed against the driver of the tour bus, because the crash was unavoidable.

Aldean and another man were on the bus at the time of the crash, Morris said, but they were not injured.
