WHITLEY COUNTY, Ind. (21Alive) -- A 26-year-old man is dead after he was allegedly attempting to elude the Churubusco Town Marshal and crashed his car into a tree.

According to police, Tristan Bender was traveling eastbound at a high rate of speed in the 6900 block of E. CR 150 N. The Churubusco Town Marshal had been chasing Bender with his siren and lights on.

Bender's vehicle traveled left of center and went off the north side of the road and struck a tree head-on. As a result of the impact, Bender, who was not wearing a seatbelt at the time, was ejected from his vehicle.

He was flown to a Fort Wayne hospital, where he was pronounced dead a short time later.

It is not known whether drugs or alcohol were involved. The crash remains under investigation with the State Police.
