Wrongful Death Lawsuit Filed for Car-Train Crash

HARTFORD CITY, Ind. (www.incnow.tv) - A north-central Indiana man has filed a wrongful death lawsuit against two railroad companies due to a car-train crash that killed his pregnant wife and 10-month old son in September 2011.

Thomas A. Janero filed suit Monday in Blackford Circuit Court seeking unspecified damages from Norfolk Southern Railway Co. and CSX Transportation. Janero contends that a building near the site of the September 2011 collision limited the visibility of approaching trains.

Janero's 22-year-old wife, Kristen Marie Janero, and their son, Xander, died when the car they were passengers in was struck by a train in Montpelier.

According to an off-duty police officer, who was behind Janero's car when it was hit. the train was sounding its horns and flashing its warning lights.

Investigators said Janero wasn't wearing a seat belt and that Xander was in a car seat but wasn't secured in the vehicle.
