Fort Wayne, Indiana (Indiana’s NewsCenter) – A news conference is set for 11:00am Monday, August 29, 2011 to announce the second wrongful death suit to be filed in the Indiana State Fair stage collapse. This suit is on behalf of the Estate of Alina BigJohny, of Fort Wayne, and her parents, Robert and Polly BigJohny.
The lawsuit alleges gross negligence and recklessness by the promoters and producers of the event, according to attorneys for the family.
The 23-year-old Alina BigJohny was crushed to death in the stage collapse just before the Sugarland concert on August 13th.
BigJohny is one of seven people killed in the collapse. Dozens of other people were injured.
The first wrongful death suit was filed on behalf of 42-year-old Tammy VanDam, of Wanatah. She is survived by her 17-year-old daughter, Courtney, and her life partner, Beth Urschel.
The law firm of Kenneth J. Allen & Associates won a temporary restraining order last week on behalf of the victims from LaPorte Circuit Court that orders the State of Indiana to preserve and protect all evidence of the collapse until engineering experts retained by the firm are able to conduct scientific inspection and testing.
