Judge Says Dems Cannot be Fined for Right-to-Work Walkout

February 7, 2012 Updated Feb 7, 2012 at 12:44 PM EST

INDIANAPOLIS (Indiana’s NewsCenter) -A Marion County judge has ordered state House Republicans to return the thousand-dollar a-day fines levied against House Democrats after they walked out for five weeks last year over the "Right-to-Work" issue.

The judge also halted the collection of similar fines against the Democrats in this year's 8-days of boycotts.

Attorney General Greg Zoeller will ask the State Supreme Court to review the decision.

The state's highest court agreed last month to review the underlying issue of whether the legislature can fine lawmakers and force the state's auditor to withhold those fines from paychecks.

Governor Daniels signed "Right to Work" into law last week.

The measure bans unions from collecting mandatory fees.
