First 2014 Allen County Homicide Declared Self-Defense (VIDEO)

FORT WAYNE, Ind. (21Alive) -- The Allen County prosecutor will not press charges for the first reported homicide of 2014 and have ruled it an act of self-defense.

According to investigators, on January 19th 32-year-old Damian Miller struck a Dupont Bar and Grill security guard in the head with a glass bottle and began assaulting him. The security guard then drew his weapon and fatally shot Miller in self-defense.

According to state law, a person is justified in using deadly force and doesn't have to retreat if the person reasonably believes that force is necessary to prevent harm to themselves. The prosecutors review of the case determined that the security guard has sufficient cause to believe such force was necessary.
