KOSCIUSKO COUNTY, Ind. (www.incnow.tv) -- A new judge will be presiding over the appeals case of Paul Gingerich.

According to our partner in Indianapolis, WTHR, the appeals hearing will determine if Gingerich should be tried as a teen or adult. He is now 15-years old and is in juvenile prison for helping a friend kill his stepfather in 2010.

Gingerich was sentenced to 25 years behind bars, but the Indiana Court of Appeals threw out his guilty plea and sentence, saying the Kosciusko County judge rushed when he waived the case to adult court.
