KOSCIUSKO COUNTY, Ind. (Indiana’s NewsCenter) – A 12 year old Kosciusko County boy who was sentenced to serve 25 years in a juvenile facility for killing a man is appealing his conviction.
Paul Gingerich was convicted of helping his friend kill his stepfather in Cromwell back in 2010
He was tried as an adult.
According to our Partners in News the Journal Gazette, a judge has given the go ahead for Gingerich's attorneys to appeal the conviction.
His attorney claims the trial judge refused a request to have the boy evaluated by mental health experts and refused to consider whether his being 12 at the time made him incompetent to help in his defense.
