Insurance Money On The Line In New Pattison Court Battle

WABASH COUNTY, Ind. (Indiana’s NewsCenter) - Murderer Scott Pattison lost his fight for freedom, but he's still in a fight for his dead wife's insurance money.

Though he's been convicted, his attorney holds out hope the conviction will be reversed under appeal.

In November, a jury found Scott Pattison guilty of asphyxiating his wife Lisa Pattison, by pressing a barbell down on her throat.

The murder defendant and Lisa Pattison's son Dillon McCoy were named co-beneficiaries in a life insurance policy, with each designated to receive $225,000.

Friday, the attorney for McCoy made formal arguments to a Wabash County judge, claiming Scott Pattison forfeited all rights to his share of the money by his criminal conduct.

Dan Sigler/Dillon McCoy's Lawyer: " He killed Lisa Pattison, he's been convicted of that, the life insurance company has paid the money in, and we want that money for Lisa Pattison's son and family."

Scott Pattison’s lawyer, Bruce Elliott, told the judge, the defense is in the final stages of preparing an appeal, seeking to overturn Pattison's murder conviction, and that his client’s half should not go to Dillon McCoy until the appeal is settled.

Elliott said, "Once the money is gone, Your Honor, it would be very difficult to get it back."

Dan Sigler says, even if the conviction is thrown out, he believes there are grounds to keep Scott Pattison from getting his hands on any of those insurance proceeds.

The judge is taking the case under advisement for a minimum of ten days.
